the rights and obligations of both parties.
1. The rights and obligations of the
certification client
1) The certification client shall
truthfully submit the Certification Application Form and relevant certification
materials to Party A, and ensure the authenticity of the submitted materials.
In the production/processing process, the standards for applying for
certification and corresponding laws and regulations shall be strictly
implemented, and the certification requirements shall be continuously met when
they change.
2) According to the coverage of products
applying for certification, establish a quality management system that conforms
to the certification basis and implement it.
3) Abide by the certification contract
signed by both parties, and according to the inspection plan, the certification
client shall provide food, accommodation, transportation and corresponding
working conditions for the inspection team.
4) The certification client shall actively
cooperate with the inspectors during the inspection, and assign a special
person to introduce the production, processing and sales in detail to ensure
the smooth inspection. If the certification client has subcontracted
production/processing, it must explain to GFS and accept GFS's inspection of
subcontractors.
5) The certification client shall keep
relevant documents and records of organic production, processing and sales for
inspection.
6) The certification client shall implement
the rectification measures on schedule according to the nonconformities
proposed by the inspectors, and cooperate with the follow-up verification.
7) The certification client shall pay
relevant certification fees to GFS according to the contract.
8) After obtaining the certificate, the
certification client shall maintain the effective operation of the quality
management system, and publicize and use the certification certificate and
certification mark according to the relevant regulations of GFS.
9) The certification client shall pay the
relevant testing fees to the testing institution in accordance with national
regulations.
10) In case of major changes in the quality
management system or production activities, GFS shall be informed in time.
Including:
Information on legal status, business
status, organizational status or ownership change;
② Information on organizational and management changes;
(3) contact address and location change
information;
(4) Information on the management system,
production, processing, operating conditions or process changes of organic
products;
(5) information about the occurrence of
major animal and plant epidemics around the production, processing and business
premises of certified products;
⑥ Important information on the quality and safety of organic products
produced, processed and operated, such as serious quality and safety problems
or major complaints from consumers found in spot checks by relevant
departments;
⑦ The certified organization was punished for violating national laws
and regulations on agricultural products and food safety management;
⑧ The purchased raw materials or products do not meet the
requirements of certification basis;

11) If the certification client has any
doubt or objection to the inspection report prepared by the inspector, he can
explain the doubt or lodge a complaint with GFS within 10 working days from the
date of issuance of the inspection report (Tel: 0532-67739388).
12) If it meets the certification
requirements, it has the right to obtain the certification certificate in time,
and publicize it on the GFS website and the "China Food and Agricultural
Products Certification Information System" of CNCA.
13) Have the right to apply to GFS for an
organic product sales certificate within the certified quantity and variety.
14) When applicable, provide conditions for
accepting observers (such as accredited auditors or intern auditors) present.
2. Rights and obligations of
certification bodies (GFS)
1) Provide relevant public documents to the
certification client.
2) The members of the inspection team and
the inspection plan must obtain the consent of the certification client.
3) Carry out certification activities
according to GFS certification implementation procedures, conduct on-site
inspections and issue inspection reports.
4) Abide by the statement of fairness and
confidentiality. Without the consent of the certified client, the confidential
information concerning the certified client shall not be provided to any third
party, except as required by law.
5) Timely issue certification certificates
to those who pass the certification, and publish them on the "China Food
and Agricultural Products Certification Information System" of CNCA.
6) GFS will conduct on-site inspection on
the certified organizations at least once a year. For certified organizations
whose products have been applied for certification for more than one year at
the same time, it is necessary to conduct on-site inspection on each crop. At
the same time, according to the types and risks of products applying for
certification, the stability of the management system of production enterprises
and the overall situation of local integrity level, GFS will also obtain
certification
Organize the implementation of non-routine
inspections (or non-notification inspections), and the number of non-routine
inspections shall not be less than 5% of the total number of certified
organizations.
7) GFS shall decide whether to carry out
additional inspection for major adjustments or changes that occur within the
validity period of the certified organization, and charge corresponding fees.
During this period, the licensee shall not put the products involved on the
market.
8) In the routine inspection
(re-certification inspection) or non-routine inspection (non-notification
inspection), GFS has the right to suspend or revoke its certification
qualification, and make an announcement on the website of the center and the "China
Food and Agricultural Products Certification Information System" of CNCA.
9) Issue a sales certificate for the
certified clients who meet the certification requirements and are within the
certification quantity range.
